Your Child’s Right to a Free Public Education

All children, regardless of their or their parents/guardians' immigration status, have the right to equal access to free public education in California. This includes the following rights:

  • Right to a free public education.
  • Must be enrolled if between 6 and 18 years old.
  • Right to attend safe, secure, and peaceful schools.
  • Right to a learning environment free from discrimination, harassment, bullying, violence, and intimidation.
  • Equal opportunity to participate in school programs and activities.

Information Required for School Enrollment

Schools accept various documents to prove your child's age or residency. Citizenship/immigration status is never required for enrollment, and a Social Security number is not needed.

Confidentiality of Personal Information

Federal and state laws safeguard student records and personal details. Schools typically need written consent from parents or guardians to share student information, unless it's for educational purposes, publicly available, or required by law. Some schools may disclose basic student information, such as a directory, and must notify parents/guardians of this policy, allowing them to opt-out of the release.

Family Safety Plans if Detained or Deported

Parents can update emergency contacts and assign a trusted adult to care for the child in case of detention or deportation. Forms such as a Caregiver’s Authorization Affidavit or Petition for Temporary Guardian may be used.

Right to File a Complaint

If your child faces discrimination, harassment, or bullying due to nationality, ethnicity, or immigration status, they have the right to report it or file a complaint with the school district.
